GSA Obtains 6.2M in Retaliation Case

On June 4, 2025, Giskan Solotaroff & Anderson LLP and Walden Macht Haran & Williams prevailed at trial on plaintiff Denise Rubin’s behalf in a retaliation case she brought in 2015 against her former employer, Paul Napoli.
After ten years of litigation, a jury delivered justice to Ms. Rubin, who was retaliated against by her former employer, Paul Napoli, after filing a gender discrimination complaint against him in 2015. Ms. Rubin began working for the Napoli Bern entities in 2003 as an appellate lawyer. She was later appointed as Napoli Bern Ripka Shkolnik, LLP’s general counsel.
Mr. Napoli’s retaliation consisted of meritless and defamatory counterclaims and affirmative lawsuits he filed against Ms. Rubin as well as efforts he made to dissuade at least one other attorney from working with her.
The jury found in favor of Ms. Rubin not only on her retaliation claim, but also her quantum meruit claim, and awarded her compensatory and punitive damages in the amounts of $330,000 and $5.8 million, respectively.
The case was tied by GSA partner Jason Solotaroff, GSA paralegal Caroline Capozzi and co-counsel Milt Williams and Veronica Wayner from Walden Macht Haran & Williams.
