BMW Blower Motor Wiring and PVC Heater Recalls Litigation

A class action has been brought in the District of New Jersey against BMW North America on behalf of owners and lessees of BMW model years 2007 to 2012 BMW 128i, 328i, 328xi, 328i XDrive, 335, 335i, 335i xDrive, 335is, 335xi, 335d , M3, 525, 525xi, 528i, 528xi, 530i, 530xi, X3 3.0si, X3 xDrive30i, Z4 3.0i and Z4 sDrive3.0i containing the N51, N52, N52K, or N52T engines (the “Class Vehicles”).
All of the Class Vehicles are subject safety recalls initiated by BMW (1) to repair the Class Vehicles’ Blower Motor Wiring Harness (the “Blower Motor Wiring Recall”), which may short circuit and cause a vehicle fire; and (2) to repair the positive crankcase ventilation (PCV) valve heater wiring (the “the PCV Heater Recall”), which may also short circuit and cause a vehicle fire. So hazardous are the defects that BMW has cautioned owners of Class Vehicles not to park the vehicles indoors because of the risk of fire. However, as alleged in the complaint, BMW is failing to honor the terms of the recalls by failing to provide the necessary repairs and failing to provide loaner vehicles until the repairs have been made.
On October 30, 2019, Plaintiffs’ Preliminary Approval of the Class Action Settlement was approved by the Court. If you visited (or attempted to visit) an inmate who was housed at a New York City Department of Corrections facility between November 23rd, 2012 and October 30th, 2019, and were subject to an invasive search by a DOC employee please contact our firm. A Class Notice will be sent out on December 5th, 2019 to people who we suspect could have been victim to an invasive search. The last day to submit a claim for this case is April 27th, 2020.
