Representative Cases
We were retained to represent a family medicine resident who had been forced to resign after accusations concerning professionalism. GSA partner Jason Solotaroff convinced the program to allow the resident to rescind her resignation so that she could challenge her termination. An internal appeals hearing was scheduled but the program’s rules prohibited the resident from being represented by a licensed attorney. Mr. Solotaroff, however, arranged for a law graduate not yet licensed to appear on the resident’s behalf and prepared a detailed presentation for the advocate and resident to make at the hearing. The hearing panel overturned the termination and reinstated the resident to the program. The resident eventually graduated from the program and is currently a physician in a family medicine practice.
We were retained by an intern (first year resident) who had been terminated from his program with a couple of months left in his internship year after false allegations of sexual harassment. The termination, if permitted to stand, would have prevented our client from beginning a specialty residency program to which he had already been accepted. GSA lawyers, Jason Solotaroff and David O’Brien, determined that there was no alternative other than an immediate lawsuit and motion for emergency reinstatement, filed the lawsuit and moved for immediate reinstatement. The court granted our motion and reinstated our client, leading to a settlement which permitted him to finish the program and start the specialty residency program.
We are currently representing in federal court, in two separate cases, resident physicians who claimed that they were discriminated against based on their disabilities. One client was eventually reinstated but his career was delayed resulting in hundreds of thousands of dollars in claimed damages. The other client was terminated from his program and seeks millions of dollars in damages arising from his inability to practice in his specialty.
